FITNESS CHALLENGE PARTICIPANT RELEASE AND WAIVER OF LIABILITY
In consideration of being allowed to participate in the fitness challenge organized by Bluemorph Brands Pvt Ltd and Elevate Fitness (hereinafter collectively referred to as "Organizers"), I, the undersigned participant, hereby acknowledge and agree to the following terms:
Assumption of Risk: I understand and acknowledge that participating in the fitness challenge involves inherent risks, including but not limited to physical injury, illness, and death. I voluntarily accept and assume all such risks, known and unknown, arising from my participation in the challenge.
Release and Waiver: I hereby release, waive, and discharge Bluemorph Brands Pvt Ltd, Elevate Fitness, their officers, directors, employees, agents, representatives, and any affiliated entities (hereinafter referred to as "Released Parties") from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses, whether at law or in equity, arising out of or in connection with my participation in the fitness challenge.
Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising out of or in connection with my participation in the fitness challenge.
Medical Condition: I hereby represent that I am in good health and have no physical or mental condition that would prevent me from safely participating in the fitness challenge. I understand that it is my responsibility to consult with a physician or healthcare professional before participating if I have any concerns about my health.
Photography and Publicity: I grant permission to the Organizers to use photographs, videos, or other recordings of me taken during the fitness challenge for promotional and marketing purposes without any compensation to me.
Compliance with Rules: I agree to comply with all rules and guidelines set forth by the Organizers for the fitness challenge.
Governing Law: This release and waiver shall be governed by and construed in accordance with the laws of India.
I have read and fully understand the terms and conditions of this release and waiver. I voluntarily agree to be bound by its terms and hereby acknowledge that I am giving up substantial legal rights, including the right to sue the Released Parties.
